Who and what this applies to
State public construction/public works. Political-subdivision coverage under §36.90.265 requires a written state-funding contract, and §36.90.200 does not apply to a subdivision with population under 800.
The rules
- For satisfactory performance, §36.90.200(a) ordinarily gives the state or covered political subdivision 30 calendar days after a contract-compliant payment request. Source
- A political subdivision using grant funds and the state using federal funds instead pay within 21 calendar days after the compliant request or 21 calendar days after actually receiving the relevant funds, whichever is later. Source
- Required subcontract terms under §36.90.210 provide payment for satisfactory performance within eight working days after receipt of the corresponding payment. Withholding for performance deficiencies is subject to §§36.90.220–.240 notice procedures. Source
