Alaska retainage

Who and what this applies to

State public construction/public works; political subdivisions are covered when they have the written state-funding contract required by AS 36.90.265.

The rules

• The prime’s subcontract must require payment of retainage due within eight working days after the later of receipt of final state/subdivision payment or expiration of the AS 36.25.020(b) notice period. Source
• A subcontractor must pass retainage due to its lower tier within eight working days after receiving its share of state-held retainage. Performance-related withholding remains subject to §§36.90.220–.240. Source
