Who and what this applies to

Claim-of-lien recording and service under Fla. Stat. §713.08; claimant-specific prerequisites in chapter 713 remain separate.

The rules

• A claim may be recorded during the work or within 90 days after the lienor’s final furnishing of labor, services or materials. Section 713.08(5) uses an earlier termination-based limit when §713.07(4) applies. Source
• Serve the owner with the claim before recording or within 15 days afterward under §713.08(4)(c). Failure makes the claim voidable to the extent the failure or delay prejudices someone entitled to rely on service. Source
