Prevailing Wage in Florida — Sources checked
Who and what this applies to
Florida Statutes §218.077 restrictions on local wage mandates and purchasing requirements, including the 2024 amendment’s protection for older contracts.
The rules
- Section 218.077 generally prevents a political subdivision from prescribing an employer minimum wage other than the state or federal minimum. It also prohibits controlling contractors’ wages or benefits through purchasing and awarding bid preferences based on those wages or benefits. Source
- The section preserves authority over the subdivision’s own employees and conditions on direct tax abatements or subsidies. It yields to the stated federal-funding conflict determination to the extent necessary and preserves the other express exceptions. Chapter 2024-80 does not impair contracts entered before September 30, 2026. Source
