Kansas prompt payment

Who and what this applies to

Public contracts within K.S.A. §§16-1902–1908 and private contracts within §§16-1801–1807. The public definition excludes roads, highways and bridges, and §16-1908 excludes specified KDOT section-109 contracts. The private act excludes residential property of four or fewer units and public works, and applies to covered contracts entered on or after July 1, 2005.

The rules

• Covered public owners generally pay a proper undisputed request within 30 days; qualifying extenuating circumstances permit 45 days. An architect or engineer receiving a request must review and forward it within seven business days. Corresponding downstream payments are due within seven business days after receipt when the payment-request conditions are met. Source
• For covered private contracts, the owner pays an undisputed request within 30 days after receipt. Corresponding downstream payments are due within seven business days after receipt, subject to the request conditions. The respective public and private sections specify 18% annual interest for untimely payment. Source
