Maine prompt payment

Who and what this applies to

Construction contracts under Title 10, chapter 201-A, including covered public owners. Department of Transportation contracts and material purchases by a person working on their own property are excluded (§§1111, 1112, 1120).

Thresholds and scope

Owner terms may differ by agreement; downstream statutory payment protection overrides contrary agreements.

The rules

• The owner pays under the contract; except as otherwise agreed, interim/final invoices are due 20 days after billing-period end or invoice delivery, whichever is later. Source
• Notwithstanding a contrary agreement, for contract-compliant work the contractor/subcontractor passes through the full or proportional payment seven days after receiving the progress/final payment or the sub/supplier invoice, whichever is later. Failure accurately to disclose the upstream due date triggers subsection 2. Source
• The chapter excludes Maine DOT contracts. Source
• The chapter excludes material purchases by a person working on that person’s own real property. Source
• The definition of owner includes the State and its instrumentalities and subdivisions. Source
