Who and what this applies to

North Dakota Department of Commerce’s Community Development Block Grant (CDBG) construction program. This is a review of identified program requirements, not a conclusion that other state, local or contractual wage requirements are absent.

Thresholds and scope

The North Dakota CDBG manual requires Davis-Bacon clauses for construction contracts exceeding $2,000. The governing federal statute applies to residential rehabilitation only when the property contains at least eight units and includes a defined volunteer exception.

The rules

  • The state CDBG manual requires payment to covered laborers and mechanics at no less than the U.S. Department of Labor wage determination and at least weekly. Grantees must include the wage determination in solicitations and condition the contract award on acceptance of it. Source
  • 42 U.S.C. section 5310 requires prevailing wages for covered construction financed wholly or partly with CDBG assistance. Its residential-rehabilitation and volunteer exceptions must be applied to the project and individuals involved. Source
