Oklahoma prompt payment

Who and what this applies to

Covered written public construction contracts under the Fair Pay for Construction Act. Section 227 excludes highway, railroad, turnpike and one- through four-family dwelling contracts, and generally listed road/bridge/utility work unless part of a covered construction contract.

Thresholds and scope

Section 223 owner progress-payment rule applies to covered construction contracts exceeding $25,000.

The rules

• Section 223 requires owner progress payments within 30 calendar days after submission of a proper invoice for work performed and properly stored materials. Source
• For compliant work, §224 requires prime-to-subcontractor/supplier payment within 10 calendar days after corresponding receipt; subcontractor-to-lower-tier payment is due within seven calendar days. Source

Owner 30 days; prime downstream 10 days; lower-tier seven days.
